PBNU: administrative punishment enough for unregistered marriages

The Central Board of Nahdlatul Ulama (PBNU), the country`s largest Muslim organization, said an administrative punishment would be enough for those who were involved in unregistered marriages.
"There is no need to hand over a criminal punishment to them because an administrative sanction is enough," PBNU Chairman KH Hasyim Muzadi said here over the weekend.

He said that state regulations on marriages issues were made in the context of citizenship administration so that logical punishment, should they be punished, was in the form of a administrative sanction.
The PBNU chairman said however that viewed from the religious aspect registration of marriages was important for wives and their children, particularly those from a husband of more than one wife.
The government, in this case the Ministry of Religious Affairs, is preparing a controversial bill on unregistered marriages which will carry provisions where unregistered marriages are to be considered a crime and illegal. Violators are therefore punishable by a maximum of three months in jail or a fine of Rp1 million.
The bill is being drafted and is intended to complement Matrimonial Law No.1 / 1974. The drafting of the bill is one of the National Legislation Programs for 2010. It will among others stipulate as illegal and criminal acts of unregistered marriages, contract marriages and adultery.
It will also stipulate other matrimonial issues such as second, third and fourth marriages, out-of-court divorce and undeserved `wali` (male relative responsible for a bride). Violators of these `criminal` offenses are punishable by a range of six to 36 months in jail or a fine of Rp6 million to Rp12 million.
"Registration of marriages of citizens is within the context of state administration. This is also important in the context of religion (Islam) because it should not happen that a child is dating a sibling from different mothers" Muzadi was quoted by Antara news agency as saying. (dar)
